The definition of "hazardous waste" in Attachment #2 is even more confusing. We understand from state hazardous waste personnel who apply this definition that it cannot be converted into a list of chemicals because in some cases inclusion or exclusion depends on the processes involved. This characteristic makes this definition very difficult to use, especially in emergency response operations OSHA and the EPA are major agencies of concern. HAZARDOUS WASTE is a contaminated chemical or by-product of a production process that no longer serves its purpose and needs to be disposed of in accordance with the Environmental Protection Agency. This could include small amounts of chemicals such as parts washing solvents in a machine shop, or large amounts of construction by-products OSHA's Hazardous Waste Standards.
